Effective date: 10 July 20261. Who we are and what these Terms cover
The website located at www.inkstonechina.com (the “Website”) is operated for the Inkstone brand by Dusk Limited, a Hong Kong company (“Dusk”, “we”, “us” or “our”).
Inkstone is a brand for cultural heritage, experiential learning and heritage travel programs in China. China-side package-tour, travel agency and ground travel services are provided by 北京甲虫国际旅行社有限公司 (“JiaChong”).
These Terms govern access to and use of the Website, including newsletters, early access forms, enquiry forms, waitlists, program pages and other online content. By using the Website, you agree to these Terms. If you do not agree, do not use the Website.
2. Website information is not a confirmed booking
The Website provides general information about Inkstone, its philosophy, partners, waitlists and possible or planned programs. Program pages, dates, prices, routes, activities, images, donation statements, access descriptions and itineraries are indicative only unless confirmed in a signed or electronically accepted program agreement.
Submitting an enquiry, joining a waitlist, receiving an email, or clicking a website button does not create a confirmed booking or guarantee participation. A booking is confirmed only in accordance with the relevant program agreement, payment instructions and written confirmation issued by Dusk, JiaChong or the relevant operator.
If there is any inconsistency between the Website and a signed program agreement, booking terms, invoice or program-specific schedule, the signed or expressly accepted program document controls.
3. Programs, operator role and eligibility
Inkstone programs may involve cultural sites, villages, conservation projects, restoration-site exposure, workshops, walking, rural travel, field documentation and community engagement. Specific risks, requirements, inclusions, exclusions, cancellation rules, insurance arrangements and payment terms will be stated in the relevant program agreement.
Unless a program expressly states otherwise, Inkstone programs are intended for participants aged 18 or above. We may decline, waitlist or remove an applicant where required for safety, eligibility, operational, legal, insurance or community-consent reasons.
Dusk is not a licensed mainland China travel agency. China-side travel services are provided and arranged by JiaChong. Dusk provides brand, website, international-facing, admissions, program curation, communications, payment administration and related support services as stated in the relevant documents.
4. Payments
The Website itself does not require payment unless Dusk or an operator separately issues written payment instructions or an invoice for a specific program. Unless expressly stated otherwise in those instructions, the default payment route for overseas participants is bank transfer to Dusk’s Airwallex Global Account. Dusk is not required to accept cards, hosted checkout, payment links, wallets, cash or other methods.
Payments, refunds, exchange rates, bank charges, intermediary-bank charges, payment-provider checks, settlement delays and payment shortfalls are governed by the applicable invoice, payment instructions and program agreement. Do not make payment unless you have received current written payment instructions from Dusk or the relevant operator.
5. Donations, impact language and cultural preservation support
The Website may refer to cultural preservation support, restoration funding, local stewardship, impact contributions or donations. Unless a program-specific agreement states otherwise, such statements are general descriptions of Inkstone’s mission and do not create a personal tax deduction, donation receipt entitlement, charitable solicitation, trustee relationship or promise that a fixed amount will be donated in respect of a particular user.
Program-specific donation amounts, recipients, timing, use, reporting and receipts, if any, will be handled through separate program documents or cooperation arrangements. Any public statements about donations or preservation support should be read together with the applicable program terms.
6. Your use of the Website
You must use the Website lawfully and respectfully. You must not:
interfere with or attempt to disrupt the Website, its hosting, security or forms;
scrape, copy, harvest or extract Website content or personal data except as permitted by law;
submit false, misleading, unlawful, offensive, infringing or harmful information;
use the Website to impersonate another person or misrepresent your eligibility or identity;
use Website content for commercial resale, competing programs or unauthorized promotional purposes.
7. Intellectual property
The Website and its text, images, graphics, logo, trade names, design, layout, program descriptions, itineraries, photographs, videos and other content are owned by Dusk, its licensors or relevant contributors, unless otherwise stated. All rights are reserved.
You may view the Website for personal, non-commercial evaluation of Inkstone programs. You must not reproduce, modify, publish, distribute, sell, license, train machine-learning systems on, or create derivative works from Website content without prior written consent, except to the extent permitted by mandatory law.
“Inkstone” and related marks are brand assets. No license is granted except as expressly stated in writing.
8. User submissions and enquiries
If you submit information through a form, email, waitlist, enquiry or application, you confirm that the information is accurate and that you have the right to provide it. You grant Dusk and relevant program operators the right to use the submission for the purposes described in the Privacy Policy and in connection with responding to you, assessing eligibility, administering waitlists and developing or operating programs.
Do not submit confidential, sensitive or third-party information unless it is requested and necessary for the relevant purpose. If you provide another person’s information, such as an emergency contact, you must have authority to do so and must inform that person of the relevant use and transfer.
9. Third-party services and links
The Website may link to or use third-party services, including form providers, email platforms, analytics tools, payment providers, embedded media, maps, social media and partner websites. Third-party services are governed by their own terms and privacy notices. We are not responsible for third-party websites or services, although we use reasonable care in selecting operational providers for our own use.
10. No professional advice
Website content is for general informational and cultural-educational purposes only. It is not legal, medical, financial, tax, immigration, conservation, safety or professional advice. Participants are responsible for obtaining their own travel, visa, health, insurance, tax and professional advice where needed.
11. Disclaimers
We use reasonable efforts to keep Website content accurate and current, but the Website is provided on an “as is” and “as available” basis. We do not guarantee that the Website will be uninterrupted, error-free, secure, virus-free, complete or always current.
To the maximum extent permitted by law, we exclude all warranties, conditions and representations not expressly stated in these Terms. Nothing in these Terms excludes liability that cannot lawfully be excluded.
12. Limitation of liability
To the maximum extent permitted by law, Dusk and its officers, employees, contractors and agents are not liable for indirect, incidental, special, consequential, punitive or loss-of-profit damages arising from use of or inability to use the Website. This does not limit liability for fraud, intentional misconduct, gross negligence, personal injury, breach of mandatory law, or any liability that cannot lawfully be excluded.
Website-specific liability is separate from liability under any signed participant or program agreement. Program liability, cancellation, refunds and risk allocation are governed by the applicable program agreement.
13. Indemnity
You agree to compensate Dusk and relevant protected persons for direct, proven and reasonably foreseeable losses, claims, costs and expenses caused by your unlawful use of the Website, breach of these Terms, infringement of rights, or submission of false or unauthorized information. This indemnity does not apply to losses caused by Dusk’s own breach, negligence, intentional misconduct or violation of law.
14. Changes to these Terms and the Website
We may update these Terms from time to time. The updated version will be posted on the Website with a revised effective date. Continued use of the Website after posting means you accept the updated Terms. We may update, suspend or discontinue all or part of the Website at any time.
15. Governing law and disputes
These Terms and any non-contractual obligations arising from or relating to the Website are governed by the laws of Hong Kong, without prejudice to any mandatory laws that apply to you. The courts of Hong Kong have non-exclusive jurisdiction over Website-related disputes. Program-specific disputes are governed by the dispute-resolution provisions in the relevant program agreement.
16. Third-party websites and services
The Website may link to third-party websites, forms, payment providers, social media, maps or partner resources. Those third parties have their own privacy notices and practices. We are not responsible for third-party privacy practices except where we engage a service provider to process information on our behalf.
17. Social media and messaging channels.
Inkstone may maintain accounts on third-party social media and messaging platforms, including Instagram, WhatsApp and WeChat Official Account. Your use of those platforms is governed by the relevant platform’s own terms and privacy policies.
We are not responsible for third-party platform availability, security, moderation, account actions or data practices. Information posted publicly or submitted through those platforms may be visible to others depending on your settings and the platform’s rules.
